1. Controller and acceptance

Mekonekt is a digital technology service platform operating in Mexico (“Mekonekt”). By creating an account you accept these Terms and the Privacy Notice. You must be 18 or older, or have your guardian's consent.

2. Nature of the service

Mekonekt lets you create digital business cards available at a public web address, share them by QR, link or WhatsApp, download them as a contact and view visit stats. It does not include physical NFC cards or app-store apps.

3. Plans, subscription and cancellation

We offer Free, Pro and Teams plans. Pro includes a 7-day trial and Teams a 14-day trial, once per account. Subscriptions renew automatically monthly or yearly until you cancel from your dashboard. When you cancel you keep the plan until the end of the paid period; then your account returns to Free: Mekonekt branding is restored and customization is disabled, without deleting your data.

4. Refunds

Payments are non-refundable unless required by applicable law or due to a billing error attributable to Mekonekt. You can cancel anytime to avoid the next charge.

5. Acceptable use and suspension or termination for violations

You may not use Mekonekt to carry out, promote or facilitate illegal activities; impersonate others; publish illegal, misleading or offensive content; harass, threaten, discriminate against or abuse any person; infringe third-party rights; send spam; or try to access other users' data or scrape cards automatically.

Mekonekt reserves the right to remove content, restrict access, temporarily suspend or permanently terminate an account and its subscription when these Terms are violated or there are reasonable indications of illegal, offensive or abusive use. When necessary to protect people or the service, or to comply with a legal obligation, these measures may take effect immediately and without prior notice. Where legally permitted and without compromising security, we will inform the user of the reason, and they may request a review by emailing legal@mekonekt.com.

Permanent termination for violations means stopping future subscription renewals and recurring charges. Amounts already paid are subject to the refund clause and any rights granted by applicable law. These measures do not exclude other available legal remedies or the user's responsibility for their conduct.

6. Third-party data (leads)

Data visitors leave through your card belongs to you and you are responsible for handling it lawfully, including telling them how you will use it and honoring their requests. Mekonekt acts as a processor when storing it for you.

7. “As is” service and disclaimer of warranties

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including uninterrupted availability, freedom from errors or fitness for a particular purpose.

8. Security and third-party attacks

We apply reasonable security measures, but you acknowledge that no internet-connected system is completely invulnerable. Mekonekt, its administrators, partners, collaborators and providers are not liable for damages, losses or leaks resulting from unauthorized access, hacking, malware, denial-of-service attacks, failures or vulnerabilities of infrastructure or payment providers, or misuse of your credentials or device.

You are responsible for protecting your password and devices, and for not publishing on your card information you do not want to make public.

9. Limitation of liability for damages

To the maximum extent permitted by law, Mekonekt is not liable for direct, indirect, incidental, special or consequential damages, lost profits, or loss of data, customers, revenue or reputation arising from the use of or inability to use the service.

In any case, Mekonekt's total liability is limited to the amount you actually paid in the month before the event giving rise to it; for Free accounts that amount is zero.

10. User responsibility and indemnity

You are solely responsible, civilly, administratively and criminally, for the content you publish, the products or services you offer and your dealings with visitors and customers. Mekonekt does not take part in or guarantee those dealings.

You agree to defend, indemnify and hold harmless Mekonekt, its administrators, partners and collaborators from any claim, lawsuit, fine or proceeding arising from your content, your conduct or your breach of these Terms or the law.

11. Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. Any dispute is submitted to the competent courts of Quintana Roo, Mexico, waiving any other jurisdiction.
